I think this will put some pressure on Randy to perhaps come back to the UFC. We know that Dana has a little more money behind him than Randy, but if Cuban joins Randy then there might be a fight.

As a law student, the conspiracy to damage Zuffa claim not being dismissed is a huge hit against Randy. Of the charges being brought against him, i felt strongly that one would be dropped. It may still be dropped at the time of the verdict, if it doesn’t settle out of court.
Now i love Randy and feel he is a great representative of MMA, but sometimes you gotta know when to fold em. The only way that couture is going to get out of this without it costing him millions is to just finish the last two fights. Fight Nog, and if he beats him( which i highly doubt), go to Dana and ask to just sign Fedor to a one-fight deal(which Dana will most likely void). It would show that Randy is the best heavyweight by legitimately beating the top 2, and UFC would rake in cash by setting up one of the best MMA battles in history.
To me, that makes the most sense. Which of you ladies is with me?

I agree 100 percent john. Whomever is lead counsel to Couture is not properly guiding his client. If there are two things i know 100% it is that 1. The Fertittas know the law( millionaire casino owners are damn near lawyers themselves) and 2. Their money hires MUCH BETTER lawyers than Coutures money.

I’d love to see this situation resolved amicably, with Randy and Fedor going at it on the biggest stage in MMA today, which is the UFC. Will it happen? Remains to be seen…

Can’t watch the video here at work. Just curious though, on what was the motion to dismiss based? It’s typical for claim’s to withstand 2 or more motion’s for dismissal, and they’re almost always based on minor technicalities any able bodied attorney or firm should solve with ease. i.e. These things are typically no big deal.

if the courts let Couture off on this contract dispute, then everybody with a contract is going to think they can break them…..you just can’t break a contract…Couture has to be alot dumber then he looks to have thought this was going to work out in his favor……..Randy is ither going back to fight for the UFC or going to lose alot of money……along with all the respect he once had.

I’m getting tired of hearing about Randy Couture. I know, I can just ignore the story- but here’s a better outcome through all of this crap- Couture should either grow some balls and fight Nogueira or retire. Then we could all save ourselves from the pain of hearing week in week out whether or not Couture will get the fight that he is so babyishly demanding. That’s right, babyishly- it wasn’t a word until Randy Couture decided to do every thing in his life in that fashion. I’m losing all respect for Couture- you get in the ring, you prove yourself, or you shut the hell up. Couture refuses to do either and he thinks he’s king of MMA when he’s not top 3 HW. This is no big deal at all. It is a legal formality that happens in every case. If it was not filed, the lawyers leave themselves open to a malpractice suit. If it goes to trial, there will be more motions from both sides to try to get a resolution to the case before there is a verdict. They will also be denied (most likely) and it will also be no big deal. There are certain motions that must be filed to protect the lawyer and this is one. Basically, when the judge hears this motion he looks at everything in Zuffa’s favor and the case will only be dismissed if he says what you are saying is true, Zuffa, and you still have no case. That is all that happened. I’m not saying I think Randy will win, but again, its no big deal.

I agree with everyone above saying that Randy should just swallow his pride, and fight Nogueira. That is if he wants to keep fighting for a living. He has had his day in the sun, and it’s a shame he may be going out like this. To think he can win a legal battle with billionaires is ridiculous! Zuffa/Dana White will save face no matter how much it costs. I’m glad there are legally educated people in here to clear up confusion. It makes sense that this would be routine.

Man, I am glad people are starting to see Randy as the chump he is. When this all first broke last fall, everyone was on Randy’s side saying Dana should’ve got Fedor blah blah blah.
I’ve said it since the beginning. This was not about Fedor and it never was. This was about money. Dana gave Randy the world (come out of retirement and fight for the title) and not even a year later, Randy decided he wanted the universe.

this might not be as bad as it sounds…we dont know what grounds the motions to dismiss were under yet. I’m a law student, so i have a little experience with this, and there are many different motions to dismiss. He could made a motion based on a number of different claims not based on the actual merits of the case, like jurisdiction or improper process of service, so the dismissal might have only been based on procedural terms, not the actual legality and sufficiency of the claims. Does anyone know where to actually access the complaint and the answer?

Why is it than when an Org breaks a contract with an athlete (i.e. releases him/her), it’s business as usual, but when an athlete quits, he’s in breach?
Wanting out of a contract is a normal process. Just ask any CEO of any Fortune 500 company. Ask them how many contracts they re-negotiate or cancel due to changing market issues?
