Update: Sean Sherk files for extension on steroid appeal hearing

Sherk was scheduled to plead his case on Monday, August 6. Now, it looks like a resolution on the matter will not be determined until sometime in October -- the next available date on the CSAC docket.

Here's a snip from Sherk:

"I don't want this to take any longer than it has to, but I hired my lawyer just a couple of weeks ago. I want to get this done as soon as possible so I can fight B.J. [Penn] in November, but the next hearing wouldn't be until October."

Both samples takes from "The Muscle Shark" prior to his bout with Hermes Franca at UFC 73 tested positive for traces of the banned illegal anabolic steroid known as nandrolone.

He faces a fine and year-long suspension, as well as the prospect of having to forfeit his 155-pound belt.

This latest news casts an even darker shadow over the possible opponent for Penn at UFC 78 in November.

Will the UFC wait for the decision -- just one month before the event -- to announce the showdown? Will Penn face new opponent? Or, will Penn just be put on hold altogether until the status of Sherk is determined?

It's all a mystery right now as the soap opera continues. Stay tuned.

I say that if he was honestly innocent, he would have just gone, and the truth would have come out. He is not prepared he says? What do you have to prepare for if you are innocent?

If Sherk just had his hearing today, the Penn could have happened in December or he would have been stripped (some combination of Penn/Stevenson/Florian/etc. in December).

Now, what is Dana going to do? Tell Penn to train, Sherk to train, Stevenson to train, with Sherk fighting Penn if the suspension is overturned? Or say, “hey, Joe, just ready to fight in December, but you won’t know until October”? Not likely, so the next title fight won’t happen until say January or February.

That means that since Sherk won the belt in October 2006, it will have been defended all of 2 times in 14-15 months. That’s pretty ridiculous, especially considering the absurdly long wait for a welterweight title fight.

If Sherk is in fact innocent, I would hate to see his title stripped away. I would have hired some scientists to help explain the cause of what happened, and shown their tests of the truth. But since he hired a lawyer and now there is a 2 month delay, it seems more likely that he is less innocent. So, if the title is stripped away now, I wouldn’t care as much.

CSAC should of given him the date on which his attempted defence would be heard

cant see any good reason for them to allow him delay it unless hes provided evidence that he has scientists employed to do some kind of trial which will somehow prove his innocence

to determine if he is naturally at that level, they would need to do some kind of test with him training while sealed of from the outside world and any possible juicing

i hope he is innocent as id like to see him fight BJ

Who cares, you got caught, your levels were too high, end of story. It doesn’t matter if you have a genetic deficiency, they made rules saying “If your levels are over this amount, then you get banned.”

There is no defence for a positive steroid test, what are you going to do? Retake the test and not take steroids this time? It’s over for Sherk as champ.

Strip the belt, vacate it, put BJ Penn vs Joe Daddy or someone.

They need to test him again at the hearing. If his test are below 8ng/ml. Then hand him the suspension if its higher take a blood test. That will clear all of this up.

If any of us were accused of something and were facing fines and suspensions, wouldnt you want to be totally prepared ? It will be concluded and squared away in October, which is one month prior to his fight with BJ Penn. And anyway as fight fans wouldn’t you BJ Penn nut huggers want to see him win the title (potentially) against the best in the division or against a young up and comer in Joe Stevenson ?

Give it time and calm down with the anti Sherk blogs. It aint like he’s Barry Bonds who is about to break a sacred record. He tested positive for a naturally produced substance at rather low levels.

Man this Lay and Pray doper was the worst thing to happen to this division. Everyone has to wait while he is either hurt(probably from doping and overtraining), or facing suspension for steroids. All the exciting fighters at 155 and Sherk screws it up. He’s laying on the belt now and praying they take some BS excuse as to why he tests positive for steroids.

Sherk neesds to take his punishment and get on with his life. He knew the rules and failed. Both samples were positive. A hearing isn’t going to change anything, including the rules. BJ would have taken the title anyway. They need to start testing the fighters before they fight then there wouldn’t be any controversy.

Olympic Athletes (World record breaking athletes) are held to a 2ng limit. To say that an MMA fighter would naturally produce 12ng still seems a bit fishy. This has all been discussed till everyone was blue in the face though. Whether he is innocent or not, I just want to see more fights, so hurry the f*ck up Sherk.

He “could be” telling the truth. He was only twice the normal limit of an athlete of his caliber. There are non-steroid supplements out there that does boost testosterone levels which he may have taken instead of poking needles in his ass.

I would say Royce Gracie was the obvious juicer (not by appearance)with 10 times the normal level of testosterone in his blood. He too claims he is innocent but I would say it would be pretty hard to explain 10 times over than twice over.

In America you are innocent until proven guilty. Well he was proven guilty with the lab tests- not on one sample but two. So the punitive suspension, fine and belt stripping should take place. If he appeals his CONVICTION successfully, then give it all back.
He should not be on any card during his suspension time and his suspension should have started shortly after his positive test for banned substances.

Maybe fighters need to test themselves preemptively if they are going to experiment with performance enhancers that are not necessarily currently banned but might produce a positive outcome? Maybe the testing is really expensive and only NFL, NBA and MLB players can afford it.

Is the suspension already in affect? Or could he just appeal a few more times pushing the trial beyond the scheduled fight date?

I cant see this fight going off as scheduled even if he gets his trial in October. Do you think they will give a decision that day or need time to review evidence?

I hope for his innocence or just move the fight to some 3rd would country and LETS GET IT ON!!!

No, but you have a lawyer go into your court hearing and argue that the testing method was defective, the equipment was defective, the tester didn’t perform the test properly, etc.

I’m sure that Sherk’s lawyer is preparing for exactly this type of argument, with experts to testify that the test was improperly performed, the testing method was unreliable, and so on.

Everyone saying “he broke the rule, so he’s guilty” needs to learn a little about our legal system. Courts interpret rules, and I’m sure that’s what Sherk’s hearing will focus on…an interpretation of the rule.

Does anyone know what the CSAC rule actually says about this hormone level? Does the rule prohibit a certain level in your system? Or does it prohibit use of a steroid/supplement, and say that your urine/blood level will be the measure of whether you use?

Okay, check this out. Here’s the CSAC rule that applies here:

“Title 4. Business Regulations, Division 2. State Athletic Commission § 303. Administration or use of drugs.

The rule states: The administration or use of any drugs, alcohol or stimulants, or injections in any part of the body, either before or during a match, to or by any boxer is prohibited."

Okay, now look at this information from CSAC’s FAQ page, on the question whether supplements are okay to use:

“A wide range of products are considered dietary supplements including vitamins, minerals, amino acids, herbs, botanicals, and more. The Commission warns contestants that some of these products have a negative effect on performance.

Moreover, a recent International Olympic Committee (IOC) study found that 15% of the supplements tested were contaminated with steroids that would lead to a positive test. If a prohibited substance is detected in your sample — even if it was unintentional — it will result in a violation of Rule 303.

Disclose this information as early in the licensing process as possible. Don’t risk not being allowed to compete."

Sherk has a problem here. The rule is very broad, basically banning anything and everything. His only real argument is that he produced that level naturally. I do think it’s promising that CSAC recognizes that supplements can lead to a positive result, but they seem to indicate that they don’t care, you’re still going to be punished. In any event, he could get banned, but not be guilty of using steroids.

Is there any precendent for a fighter training for scheduled fight while awaiting appeal? It seems unfair to Penn for him to train like he will be having a title, then find out in October that his opponent is, in fact, suspended.

Then all they can do is move the fight back or have someone(probably Stevenson) take a title fight on short notice.

Yes the fight between Penn and Sherk was no confirmed, that is because a bout agreement has not been signed yet. However we all know that the fight is said by Dana White to happen in November at some point. So…..

Is a pretty irrelevant post being that we all know they are going to fight once this hearing for Sherk is cleared up. Only if he loses his appeal will we see BJ Penn vs. Joe Stevenson fight for the lighweight crown probably in January if this hearing is in October.

I’m more than happy to wait for this situation to be concluded. I have a ton of respect for Sherk…the guy trains like a maniac, and is a top-notch athlete (assuming he’s innocent). He lives in a country which will allow him to defend himself against the allegations – and it seems most on this board are actually against Sherk. Why?

He’s not actually holding up any UFC scheduling, unless he’s found guilty. But, there’s an easy solution for this; have other fighters training and ready to fight on a months notice. I would like to hope there would be a tourney to determine the top contenders for Penn (assuming Sherk is guilty).

It’s funny how people on this board insult Sherk for all the delays over the past year (injuries, now this steroid charge). How many bloggers have given Fedor the same treatment…he’s delaying fighting top-notch competiton (perhaps he knows his bubble will soon burst)..and there’s no indication that he actually wants to fight in the UFC. Sherk’s record is amazing, as is Fedor’s, why is there near- hatred for one of the fighters, but love for the other? At least Sherk wants to fight the best…

I wouldn’t be so hard on him if he could only finish a fight. I don’t see how they are going to get him off since both of his tests were well past the limit. We will see. Even if somehow the lawyers find a loophole ther are about 20 other LW fighters I’d rather watch than Sherk.

As for Fedor, well he is the opposite of Sherk. Sherk holds his opponent down, throw an odd elbow, then wait for the bell to ring. Fedor puts you on the ground and hits you with a sub or drops hammer fists on your face over and over.

I guess its obvious I don’t like Sherk. :)

What are you talking about? This changes everything. If Sherk is guilty who knows who Penn will fight, and who knows if they will actually keep it teh same date. He is NOT schedualed to fight BJ in Nov., nothing is confirmed, so I don’t know what your talking about.

man you guys are reason people do not take mma seriously. It is not the job of the athlete to stop his opponent it is to win, I really do not understand how you cant give him props for being one of the most dominant fighters in the sport. Thats just like not liking a football team that always shuts out their opponent but only plays strong defense and runs the ball or a basketball team like the spurs.

If Sherk is innocent after miserably failing two samples, then it will set a very bad precedence. It will give each and every fighter more incentive to take steroids knowing they can fail both tests and fight against suspension.

So a fighter should disclose what suplements, vitamins, etc they are taking to hedge against a false detection. I don’t know if he is pursuing this “side effects” angle. I thought his argument is just that he naturally produces a lot of growth hormone- maybe because his nads are the size of lemons.

I’m curious why this is the first time he has turned up positive? Did the UFC just ratchet up their testing this year?

FOr those who claim that Sherk doesnt finish fights, you should check his record before you start running off at the mouth. Yes, he hasnt finished any RECENT fights but to see the same people say over & over in each thread that he doesnt finish fights just shows that you are not the student of the game that you claim to be. If you were, you would familiarize yourself with a fighters record before you go putting your foot in your mouth.

There’s a bit of a difference between Sherk and Fedor. Sherk won the belt and then sat his needled marked arse on it for 9 months. Fedor has delayed coming over to the UFC because his manager is beating Dana White puppy with a rolled up newspaper for pooping on the floor and calling that a generous offer. If Fedor does agree to terms, wins a belt and then can’t be found and won’t return calls 5 months later, then I’ll rag him too.

Nah, pretty sure they have tested like this since teh sport really changed and got rules and regulated. Could have been something as simple as that he changed up one of his supplements.

Yeah who knows either way i’m glad he got caught, they should make supplements to a min., make it as natural as possible.

As a practical matter, Sherk is all done in the UFC and probably all done as a fighter.

The CSAC has never overturned a drug suspension for a positive steroid test.
It is unlikely to start now.

Unless Sherk has unequivocal proof that the test is flawed or that he was tainted via a third party,
his suspension is going to stick.
THe UFC isn’t going to risk its CA license by allowing Sherk to fight elsewhere.

It’s quite possible that Sherk took a supplement that was tainted.
It’s become an open secret that many over the counter supplements available at GNC and the like contain steroids.

It’s no excuse, you should ALWAYS know what you are putting in your body.
Ignorance is no excuse.

In March 2006, the FDA sent letters to four companies it said were distribut­ing steroids in over-the-counter dietary supplements.
Among the supplements identified at that time were Anabolic Xtreme Superdrol and Methyl 1-P.
Both had been analyzed, at The Washington Post’s request, by Don Catlin, then director of the UCLA Analytical Laboratory.
Catlin found anabolic steroids in both products.

The CSAC will take the position that the IOC takes.
The athlete is responsible for what he or she puts in his or her body.

Unless Sherk’s lawyer finds some convincing flaw in the test or testing procedure, I think Sherk’s only hope is to push the “It was an accident” defense, and try to get the penalty reduced. He can’t really claim that it was natural production, since he admits on film to taking a truckload of supplements every day.

Why not have a lifetime ban on ’roid users? Put it in all the new contract. Test for ’roids you are done in the UFC. That would put a little bite in it.

It’s funny how people on this board insult Sherk for all the delays over the past year (injuries, now this steroid charge). How many bloggers have given Fedor the same treatment…he’s delaying fighting top-notch competiton (perhaps he knows his bubble will soon burst)..and there’s no indication that he actually wants to fight in the UFC. Sherk’s record is amazing, as is Fedor’s, why is there near- hatred for one of the fighters, but love for the other? At least Sherk wants to fight the best…

AFAIK The delay in UFC negotiations centers around Fedor wanting to participate in the Sambo championships in Russia and the UFC not wanting him to do so. And BTW, if you know anything about MMA, Pride’s heavyweight roster was better than anything UFC had pre-merger. Hell, half of the “top-notch competition” you’re referring to is Cro Cop and Minotauro, who are bith Pride products.

man you guys are the reason people do not take mma seriously. It is not the job of the athlete to stop his opponent it is to win, I really do not understand how you cant give him props for being one of the most dominant fighters in the sport. Thats just like not liking a football team that always shuts out their opponent but only plays strong defense and runs the ball or a basketball team like the spurs.

Are you kidding me!!!….Id love to see what kind of a fighter you are to think its enjoyable to watch some hold down an opponent for 25 min….besides have him losse the juice then see if he can dominate and hold someone down…your the reason why people dont take MMA seriously….are you even a Fighter??!!

You have got to be kidding, right? Even if one is innocent, coming out OK in a legal or administrative proceeding is more than just showing up and saying “your honor, I am innocent”. It takes time to prepare a defense, even for the innocent. This is even more so in a case like this that involves scientific evidence as to testing, etc.

It isn’t about being natural, it is about being the best you can and hopefully only taking things that you can within the rules. To be at the top of your sport these days, you can’t just down some raw eggs in the morning and be ready. Enter the new millenia buddy.

A few things. U @ho’s who think you know he’s guilty need to wait. You should also know a few facts:
1) The testing is flawed scientifically
2) The testing is performed by a party that would gain by a guilty verdict..the commission. They get a huge fine paid to them. in what other area would this be acceptable??? isnt this conflict of interest? yes!
3) Dozens of other fights tested higher than sean and were later cleared…again, flawed testing system.
4) Sean tested 6 above normal, so he was at a 12. The others later cleared were in the 40’s.
5) lastly, these levels can be achieved naturally by have a strenuous hardcore work out schedule…which sean has!

peace out. all this is true, stop being a part of the mob and think for yourselves! Get your crap straight, sean is clean and works hard!!!

You have made claims with no basis in fact.1) The test is perfectly valid and NO ONE has ever proven it to be “flawed scientifically”.
A bunch of juicers make specious claims based on anecdotal evidence and you swallow it hook, line and sinker.

2) The CSAC does not gain a thing by suspending an athlete.
It is performing it’s duty prescribed BY LAW.

Sean Sherk has been taking “supplements” that contain anabolic steroids.

The fact he was too lazy to verify that his supplements were clean is HIS problem, and NOT that of the CSAC.

Just a few points I’d like to make are,

He “could be” telling the truth. He was only twice the normal limit of an athlete of his caliber. There are non-steroid supplements out there that does boost testosterone levels which he may have taken instead of poking needles in his ass.

I would say Royce Gracie was the obvious juicer (not by appearance)with 10 times the normal level of testosterone in his blood. He too claims he is innocent but I would say it would be pretty hard to explain 10 times over than twice over.

Chances are more likely that Gracie did something innocent and got caught, he knew that there would be tests and probably took something that he did not know would elevate his levels where Sherk being so close to the limit has probably been cycling his use and screwed up by taking his juice just a little to cloose to his test time. he did the crime let him pay the time, like it or not Sherk CHEATED.

I would say my guess is dude did steroids so he should be stripped immediatley just the fact that they found a foreign substance makes him guilty, anyone that short and that buff probably is on steroids dudes more ripped than hughes and hughes is a natural with extroradinary power, so what does that tell you, stop waisting all of the MMA fans time tell the damn truth either you did the juice or you did not, either way you will loose the belt to BJ PEnn any how.
